Compliance Services covers the documentation and annual filings most employers need when they offer pre-tax benefits or a group health plan:

Nondiscrimination testing
Annual IRS-required tests for Section 125 and related plans.
Section 125 plans are subject to annual nondiscrimination tests that check whether highly compensated and key employees disproportionately benefit from the plan. We run the required tests and deliver results with enough detail for you to course-correct if a test fails:
- Eligibility test
- Contributions test
- Benefits test
- Key employee concentration test
- 55% average benefits test (Dependent Care FSA)
Who can't participate: Owner categories including more-than-2% S-corp shareholders, LLC members, and sole proprietors cannot participate in Section 125 or Section 105 plans — and neither can spouses and/or relatives of owners. If your organization includes any of those, plan design needs to account for the carve-out up front.
